1. General remarks

"The e-Store section of Punishing Records website" (hereafter known as the 'the e-Store') is an online shop where customers can buy merchandises of bands signed by Punishing Records.

2. Prices

Merchandises applicable prices are those written on the e-Store at the time of ordering.

Punishing Records makes no charge for delivery, no matter the order quantity.

VAT, where applicable, is included in the quoted price.

3. Customs

When ordering products from the e-Store for delivery outside of Switzerland you may be subject to import duties and taxes, which are levied once the package reaches the specified destination. Any additional charges for customs clearance must be borne by you; we have no control over these charges. Customs policies vary widely from country to country, so you should contact your local customs office for further information. Additionally, please note that when ordering from the e-Store, you are considered the importer of record and must comply with all laws and regulations of the country in which you are receiving the products. Your privacy is important to us and we would like our international customers to be aware that cross-border deliveries are subject to opening and inspection by customs authorities.

4. Payment terms

When paying with PayPal, your account will be billed immediately, not when the goods are dispatched.

If payment is made by credit card, the card will be debited immediately, not when the goods are dispatched.

5. Delivery

A pre-ordered merchandise is dispatched prior to its release date with the intention that it arrives with you on the actual release day. We can't guarantee that your order will arrive the exact day of the product's release. A delay in delivery will never result in a reduction in the selling price.

Regular orders (not pre-orders) will be dispatched as soon as possible. Once dispatched, they should arrive 2-3 days later if the dispatching address is in Switzerland. 6. Refusal of acceptance

In the event of unjustified refusal to accept the goods delivered, we reserve the right to charge the costs incurred.

7. Warranty / Liability

Liability on the goods supplied is limited to a replacement delivery. Claims for rescission of contract or reduction in payment will not be considered provided a replacement delivery can be made within a reasonable period of time.

Complaints regarding product defects may be made within 8 days. If an inspection of the defective product reveals that the defect is attributable to negligence on the part of the purchaser (such as damage due to careless handling), the purchaser shall be liable for the cost of the replacement delivery.

We accept no liability for any transport damage caused by postal services.

We accept no liability for any damage caused by the copy protection.

Our liability for our own fault, as well as that of our legal representatives and agents is limited to intent and gross negligence. This does not apply to the breach of fundamental contractual obligations and absence of warranted characteristics.

8. Return / Exchange

We do not exchange t-shirts if they don't fit you. You must be carefull selecting their size(s) while ordering them.

For copyright reasons, we are only able to take back or exchange CDs if they are still in their original cellophane. This, of course, does not apply to manufacturing faults. Returns must be accompanied by the invoice or delivery note, otherwise it will not be possible to process them. Transport damage must be reported within 48 hours, otherwise the entitlement to a free replacement lapses. Returns can only be accepted by agreement with us, so you must write us an e-mail or a letter BEFORE returning anything.

The postage costs incurred will be deducted from the invoice. These costs can't exceed the merchandise price and will only be refunded, however, if the goods were incorrectly delivered by us or defective.

9. Data protection

The e-Store only records essential data and uses these within the scope of order processing. Personal data will be treated as confidential and will not be passed on to third parties for advertising purposes.

10. Place of jurisdiction

Our business activities are based exclusively on Swiss law. The place of jurisdiction is Lausanne.
